Standard Rental Agreement

Assurance of Domain Name Rental

  1. Rental fees include all domain names where they form part of a pack.

  2. Domain names will not be sold to a third party while they are being rented.

  3. The renter has first option, without obligation, to purchase domain names they are currently renting.

  4. Rental renewed fees will be fairly priced and based on independent appraisals.

  5. Custom security arrangements can be made for the update of domain records.

  6. For peace of mind, all domains are set for automatic renewal.

  7. Due care will be taken to ensure a good working relationship exists between the domain holder and his client.

Four Basic Rules

  1. The renter of a domain name has no right, implied or otherwise, to administer, to control, to challenge or to gain ownership (“registration”) of a domain name.

  2. The activities of the renter are both lawful and in good faith of all applicable laws as they apply.

  3. No liability will be placed upon the domain holder (“registrant”) for loss, or potential loss, of earnings / goodwill.

  4. When rental of a domain name ceases, all rights relating to subsequent data traffic and good faith are surrendered to the domain holder.

The Small Print

Domain names defined

  1. A domain name is a unique identity which is based on the Domain Name System (DNS) and widely recognised as the centre of administration and control. The owner (“registrant”) of a domain name is better described as the lease holder of a unique identity for which they are solely responsible to administrate and control.

  2. Domain names can be used to control resources such as email or a website. The use of a domain name may or may not be limited by protocols or services and they may be used in conjunction with private or publicly accessible systems.

  3. Domain names can be used to direct data / services to different physical location in the address topology of a network, both globally or locally. In such instances, a translation is performed between a domain name and a corresponding IP address.

  4. The holder of a domain name is bound by the rules of it’s registry and legally bound by laws for the jurisdictions in which he or she resides.

Rent Rules

The renter of a domain name agrees that:

  1. Due care will be taken to ensure the above “Four Basic Rules” are adhered to.

  2. The rental period will last at least six months. All fees are payable in advance and will not vary during the agreed period.

  3. Changes to domain attributes are only permitted during the agreed rental period.

  4. Various attributes of a domain name may change at the discretion of the owner (“registrant”) or as directed by law or regulation.

  5. The renter will not loan or rent subdomains to a third party without written consent.

  6. The renter will not attach bad faith to a domain name by misrepresentation or through the sending of unsolicited email.

  7. No direct or indirect attempt will be made to interfere with the normal day-to-day operation of this service.

  8. A final purchase price remains at the discretion of the domain name holder (“registrant”). Previous payments will be deducted from the final purchase price. All fees are payable in advance.

Declaration

This is a binding contract between the proprietor Mark Ford and his client, paying or otherwise. Partnerships and variance of terms are available on all large orders.
